LIMIT OF LIABILITY

THE ICON limit OF LIABILITY

Submitting any film, print, slide, negative or art work to this firm for processing or other handling constitutes an agreement by you that any damage or loss by our company, subsidiary, or agents, even if due to the negligence or other fault of our company, subsidiary, or agents, will only entitle you to replacement with a like amount of unexposed film and processing. The Icon exercises reasonable care in handling all film, negatives, digital images, digital cards, CDs, etc. Our company, subsidiary, or agents do not assume responsibility for loss or damage due to mechanical or human failures which could occur due to delicate materials and processes involved, including fire, theft, negligence etc., except to replace damaged film with unexposed film of the same kind. Except for such replacement, the acceptance by our company, subsidiary and/or agents of the film, print, slide, negative or art work is without other warranty or liability, and recovery for any incidental or consequential damages is excluded. Dyes used in color materials may change in time. These products are not warranted against change in color or density over time. The Icon does not warrant that the function of digital files will meet all your requirements. No other warranty is offered, expressed, or implied. We are not responsible or liable for any damages for film or other materials you send to The Icon or The Icon sends to you which are damaged, lost, not timely delivered or misplaced in transit by any delivery service used including but not limited to the U.S. Postal Service and FedEx.

ATTENTION

We only store the film/prints for a maximum of 30 days. After that, we will dispose of the material at any time. Please arrange to pick up your physical assets or have them shipped.
All digital files are deleted from our servers after 14 days.
